Notice of Public Spaces Protection Order for the Borough of Castle Point

The Public Spaces Protection Order – (Castle Point Borough Council) 2023

Castle Point Borough Council hereby makes the following Public Spaces Protection Order requiring that “All dogs must be kept on their leads and the leads shall be in the control of the person or persons in charge of the dog or dogs”


The Order shall apply to the foreshore footpath seaward side and beaches between sea defence gate 17 opposite Maurice Road and Thorney Bay, Canvey Island between 10am to 6pm from the 1 April and 30 September each year. The Order will take effect from the 1 April 2023 and will remain in force for an initial period of 3 years.


It will be an offence for any person in charge of a dog or dogs not to have the dog or dogs on a lead and not to be in control of the lead or leads. A person who fails to comply with any obligation imposed by this Order will be guilty of a criminal offence by virtue of Section 67(1) of the Anti-social Behaviour Crime and Policing Act 2014 and liable to a fine on summary conviction not exceeding level 3 on the standard scale.


The Order will not apply to a person who is registered as a blind person in a register compiled under section 29 of the National Assistance Act 1948, or to a person who has a disability which affects their mobility, manual dexterity, physical co-ordination or ability to lift , carry or otherwise move everyday objects, in respect of a dog trained by Dogs for the Disabled (registered charity number 700454), Support Dogs (registered charity number 1088281) or Canine Partners for Independence (registered charity number 803680) and upon which they rely for assistance.


For the purposes of this Order:A person who habitually has a dog in his possession shall be taken to be in charge of the dog at any time unless at that time some other person is in charge of the dog.


The majority of dog owners in the Borough act responsibly when walking their dog or dogs, however this Public Spaces Protection Order has been made to deter irresponsible dog ownership which adversely impacts on the enjoyment of other visitors to Canvey seafront
