Variations to existing Licences
Variation of a Premises Licence (Full/Minor)
If you wish to apply to change your premises licence there are two methods available, a full variation and a minor variation. For your application to be considered for a minor variation the changes being proposed will not impact adversely on any of the four licensing objectives and would usually consist of one or more of the following changes:
- Small changed to the structure or layout of the premises
- The addition of authorisation for late night refreshment or regulated entertainment (such as performance of plays or film exhibitions)
- Small changes to licensing hours (but see blow on changes that relate to alcohol)
- Revisions, removals and additions of conditions
Minor variation process cannot be used to:
- Add the retail or supply of alcohol activity
- Extend licensing hours for the sale or supply of alcohol at any time between 11pm and 7am
- Increase the amount of time on any day during which alcohol may be sold by retail or supplied
- Extend the period for which the licence or certificate has effect
- Transfer the licence or certificate from one premises to another, or vary substantially the premises to which it related
- Specify, on a premises licence, an individual as the premises supervisor
If you are uncertain if your application would be a minor variation you can contact us by email at licensing@castlepoint.gov.uk to clarify. If your application will be a minor variation you can make the application online by using our form below:
If not you will need to make a Full Variation to make your changes, unless they are to transfer the licence to another person/business or to change the Designated Premises Supervisor. This application will function similar to an application for a new premises licence including placing a notice in a newspaper, please refer to the applying for a Premises licence page for further details. To apply please use the below form:
Variation of Premises Licence to change Premises Supervisor
To apply for variation of a Premises Licence following change of the Premises Supervisor, you must send to the Licensing Authority:-
- a completed application form
- the premises licence
- a form of consent given by the individual whom the applicant wishes to have specified as the Premises Supervisor
- the fee of £23.00
- A copy of the application must also be given to the existing Premises Supervisor and sent to the police
Only the police can object to the application, on the grounds of crime prevention if someone has a relevant criminal conviction. If there are no representations made the Licensing Authority must grant the licence. If representations are made, a hearing will be held before the Licensing Sub-Committee.
Application to Transfer of Premises Licence
To apply to transfer a Premises Licence, you must send to the Licensing Authority:-
- a completed application form
- the premises licence or certificate
- a form of consent given by the previous licence holder
- the fee of £23.00
If you are unable to gain the consent of the previous licence holder please contact us by email licensing@castlepoint.gov.uk to discuss.
Duty to notify of change of name or address of licence holder or Designated Premises Supervisor (DPS)
As the holder of a premises licence, you must notify the Licensing Authority as soon as possible if you have changed your name, address or have any convictions for relevant or foreign offences.
This is to be used only where it's the same person or company but with a different name (for example, their name has changed by marriage). If a new person or company has taken on responsibility for the licence, then an application to transfer a premises licence is needed instead (see above).
The DPS must also notify us of any change in their name or address. Notification must also be given to the premises licence holder by the DPS.
